A Will is important to ensure your estate is handled in the way you want to after your death, but is especially important if you own large assets (such as real estate) or have children.

At your first appointment, we will need the following personal details for you, your spouse/defacto, children, other beneficiaries and your executors:

  • Full name (including any other names the person may be known by)
  • Address
  • Occupation
  • Date of birth

We will also need your marital status and your relationship to any potential executors.

If you already have a Will and are looking to update it, it’s important to bring that along to your appointment as well.

We will then discuss with you how you want your assets to be distributed upon your death. When considering potential beneficiaries we may also discuss whether the distribution is wise and just, as well as any obligations you may have under a former marriage or to other members of your family.

Once we have all of the necessary background information we will discuss your key assets and any liabilities, how these may form part of your estate and how they may be distributed. The type of information we need in order to do this include details of your:

  • Real Estate
  • Leasehold property
  • Household contents valuation, including any key jewellery or other items
  • Vehicles, including cars, boats etc
  • Bank Accounts
  • Life Insurance and Superannuation Polies
  • Shares held in Public or Private companies
  • Other assets
  • Discretionary Trusts or Unit trusts, including copies of Trust Deeds

You will have the opportunity to review a draft of your Will and make any changes before finalising it. It’s important it includes all details of how you want your estate managed, to reduce the chances of things not happening how you wanted or someone contesting the estate.
