Conveyancing encompasses a broad range of land transactions, but most commonly it involves the transfer of land from one owner to another.

There are a number of matters involved with conveyancing, which may include:

  • negotiating with the bank who currently holds a mortgage on the property
  • negotiating with the bank who is financing the purchase
  • ensuring the transfer of ownership and settlement is correctly completed
  • payment of Stamp Duty and Land Titles Office fees, and
  • notifying local State and Federal authorities of the change of ownership.

Buying or selling through a real estate agent

When buying or selling through a real estate agent, your solicitor will take the matter from the point of an executed contract through to completion of the change of ownership.

Private sales

If you have sold or purchased a property through a private sale or transferring land (such as between family members) your solicitor will have to attend to additional matters. This would include negotiating and attending to the execution of a contract.

In addition to routine conveyancing, we can also advise in the following areas:

  • removing a deceased proprietor from a certificate of title
  • subdivisions, community titles, strata titles and surveying issues
  • encroachments, easements and other charges over land
  • mortgages, securities and lending, including private contracts
  • commercial and residential leasing
  • land disputes.
